Terms & Conditions

These terms apply to your use of this website and to every order you place with Sharma Sweets, a sole proprietorship owned by Pradeep Barua, with its place of business at 42/2, Netaji Subhas Chandra Bose Road, Kolkata – 700040, West Bengal (KMC Certificate of Enlistment No. 0091 2400 9755). By using the website or placing an order you agree to these terms, together with our Privacy Policy, Refund & Cancellation Policy and Shipping & Delivery Policy.

1. Using the website

• You must be at least 18 years old, or ordering with the involvement of a parent or guardian.
• Use the website only for lawful purposes. Do not attempt to interfere with its working, access it by automated means, or misuse the order process.
• We may update, suspend or withdraw any part of the website at any time.

2. Products

• Our sweets, cakes and bakes are prepared by hand. Colour, shape, decoration, size and packaging may vary slightly from the photographs, which are for illustration.
• Weights shown are approximate finished weights. Piece counts are exact.
• Products may contain or come into contact with milk, nuts, wheat (gluten), soy and eggs. If you have an allergy, please ask us before ordering.
• Storage and shelf-life guidance is shown on each product page. Please follow it once you receive the order.

3. Pricing

• All prices are in Indian Rupees (₹) and include applicable taxes.
• Delivery is charged at ₹60 on orders below ₹999 and is free above that. The delivery charge and any discount are shown clearly before you pay. No other charges are added.
• Prices may change without notice, but the price shown at checkout when you place the order is the price you pay. If a price is shown incorrectly because of an obvious error, we will contact you before processing the order, and you may cancel for a full refund.

4. Availability

All products are subject to availability. Some items are seasonal (for example, nolen gur sweets in winter) or depend on fresh ingredients such as fruit. If something you ordered is not available, we will contact you to offer a substitute or a refund for that item.

5. Placing and accepting orders

• When you submit an order, you are making an offer to buy. A contract is formed only when we confirm the order by phone, SMS, email or WhatsApp.
• We may decline or cancel an order — for example, if the delivery address is outside our area, the requested slot is not available, a product is unavailable, or the order appears fraudulent. If you have already paid, the full amount will be refunded.
• Custom, photo, theme and tiered cakes are confirmed only after we agree the design with you. Complex designs may carry an additional charge, which we will tell you about before we start.
• Cakes need at least 24 hours’ notice and custom cakes at least 48 hours; bulk and corporate orders may need more.

6. Your responsibilities

• Give a correct and complete name, mobile number and delivery address, and keep your phone reachable around the delivery slot.
• Make sure someone is available to receive the order, and store perishable items as advised.
• Check the order at the time of delivery and tell us immediately if anything is wrong (see the Refund & Cancellation Policy).
• Only send photos or messages for cakes that you have the right to use. We may refuse any photo or message that is offensive, infringes someone else’s rights, or that we are not comfortable printing.

7. Payment

Online payments are processed by a third-party payment gateway. Your order is confirmed only after the payment is successful and verified. We do not store card, UPI or banking credentials. See Payment Information for accepted methods.

8. Delivery

We deliver within Kolkata on the date and in the slot confirmed with you. Delivery times are estimates; delays can occur because of traffic, weather, festivals or other events outside our control. Full details are in our Shipping & Delivery Policy.

9. Cancellation and refunds

Because our products are perishable and often made to order, cancellation and refunds are limited. Please read our Refund & Cancellation Policy before ordering.

10. Intellectual property

The Sharma Sweets name, logo, text and design of this website belong to Sharma Sweets. You may not copy or reuse them for commercial purposes without our written permission. Product photographs may be licensed from third parties.

11. Limitation of liability

To the extent permitted by law, our liability for any order is limited to the amount you paid for that order. We are not responsible for losses caused by incorrect information you provided, improper storage after delivery, or events outside our reasonable control. Nothing in these terms limits your rights as a consumer under the Consumer Protection Act, 2019.

12. Governing law

These terms are governed by the laws of India. Courts in Kolkata, West Bengal have jurisdiction over any dispute.
